Welcome to Wander Lab
These Terms of Service ("Terms") govern your access to and use of Wander Lab, an educational platform operated by EverBot LLC ("we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms and our Privacy Policy.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING WANDER LAB.
If you do not agree to these Terms, you may not access or use our services.
1. Acceptance of Terms
1.1 Agreement to Terms
By creating an account, accessing, or using Wander Lab, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
1.2 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Sending an email to your registered email address
- Posting a notice on our platform
- Updating the "Last Updated" date at the top of these Terms
Your continued use of Wander Lab after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our services and may terminate your account.
1.3 Additional Terms
Certain features or services may be subject to additional terms and conditions, which will be presented to you at the time of use.
2. Age Requirements and Account Creation
2.1 Parent/Guardian Account Requirement
Wander Lab is designed for children in grades 2-12, but all accounts MUST be created and managed by a parent or legal guardian who is at least 18 years old.
You represent and warrant that:
- You are at least 18 years of age
- You are the parent or legal guardian of any child you add to your account
- You have the legal authority to agree to these Terms on behalf of yourself and any children on your account
2.2 Parental Consent
By creating an account and adding children to the platform, you provide verifiable parental consent under the Children's Online Privacy Protection Act (COPPA) for the collection, use, and disclosure of your child's personal information as described in our Privacy Policy.
2.3 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your child uses the platform appropriately
- Supervising your child's use of Wander Lab
- Reviewing the daily digests and safety alert emails we provide
2.4 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. Providing false or misleading information may result in account termination.
2.5 One Account Per Family
Each family subscription is intended for use by one household. Sharing account credentials with individuals outside your household is prohibited.
3. Acceptable Use Policy
3.1 Permitted Uses
Wander Lab is designed for educational purposes. You and your children may use the platform to:
- Ask questions and explore educational topics
- Engage in learning conversations across various subjects
- Develop critical thinking and curiosity skills
- Access age-appropriate educational content
3.2 Prohibited Uses
You and your children agree NOT to use Wander Lab to:
Harmful or Illegal Activities:
- Engage in, promote, or facilitate any illegal activities
- Harass, threaten, intimidate, or harm others
- Promote violence, self-harm, or dangerous activities
- Create, share, or request inappropriate, sexual, or adult content
- Bully, stalk, or harm other users or individuals
Platform Abuse:
- Attempt to circumvent safety measures or content filters
- Reverse engineer, decompile, or attempt to extract source code
- Use automated systems (bots, scrapers, etc.) to access the platform
- Overload, interfere with, or disrupt our servers or networks
- Attempt to gain unauthorized access to any part of the platform
Intellectual Property Violations:
- Infringe on copyrights, trademarks, or other intellectual property rights
- Use the platform to plagiarize or cheat on schoolwork
- Copy, distribute, or create derivative works from our content without permission
Misrepresentation:
- Impersonate any person or entity
- Misrepresent your identity, age, or relationship to a child
- Provide false or misleading information
Commercial Misuse:
- Use the platform for commercial purposes without our written permission
- Resell, sublicense, or redistribute access to Wander Lab
- Use content generated by the platform for commercial purposes
3.3 Monitoring and Enforcement
We reserve the right, but are not obligated, to:
- Monitor use of the platform for compliance with these Terms
- Remove or refuse to display content that violates these Terms
- Investigate suspected violations
- Take appropriate legal action against violators
3.4 Reporting Violations
If you become aware of any violation of these Terms, please report it immediately to info@everbot.tech.
4. AI Technology: Capabilities and Limitations
4.1 AI-Powered Educational Tool
Wander Lab uses artificial intelligence (Claude by Anthropic) to power Arf, your child's AI curiosity companion. Arf generates educational responses to your child's questions. While we strive to provide accurate and helpful information, you acknowledge and agree that:
AI is not perfect:
- AI-generated responses may contain errors, inaccuracies, or outdated information
- AI cannot replace human teachers, tutors, or educational professionals
- AI responses are generated based on patterns in training data and may not always be contextually appropriate
AI is not a human:
- The AI does not have consciousness, emotions, or genuine understanding
- The AI cannot form real relationships with your child
- The AI should not be treated as a counselor, therapist, or trusted confidential advisor
Educational limitations:
- Responses are for educational exploration, not definitive academic instruction
- AI-generated content should not be submitted as your child's own work
- The platform is a supplement to, not a replacement for, formal education
4.2 No Guarantees of Accuracy
WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR SUITABILITY OF ANY AI-GENERATED CONTENT.
You acknowledge that:
- AI responses may be incorrect, incomplete, or misleading
- You are responsible for verifying important information from authoritative sources
- The platform should not be relied upon for medical, legal, financial, or other professional advice
4.3 Educational Use Only
AI-generated content is provided for educational and informational purposes only. It does not constitute:
- Professional advice (medical, legal, financial, therapeutic, etc.)
- Academic instruction or certified educational curriculum
- Personalized recommendations for your child's specific educational needs
- Diagnostic or treatment information for any condition
4.4 Parental Supervision Required
Parents and guardians are responsible for:
- Reviewing their child's learning activities through daily digests
- Contextualizing AI responses for their child's age and maturity level
- Correcting misconceptions or inaccuracies their child may encounter
- Determining whether content is appropriate for their individual child
5. Safety Systems: Capabilities and Limitations
5.1 Our Safety Commitment
We have implemented safety measures designed to:
- Filter age-inappropriate content
- Monitor for potentially concerning conversations
- Alert parents via email to safety-relevant activities
- Provide transparency through daily curiosity digests
5.2 Safety Notification System
Wander Lab uses a two-tier notification system to keep parents informed:
- Critical Alerts: When our AI safety system detects content indicating potential self-harm, abuse, or harm to others, an immediate email notification is sent to the parent's registered email address. These alerts include the content that triggered the alert, context from the conversation, and suggested next steps.
- Daily Curiosity Digest: A scheduled email summarizing your child's learning activity, topics explored, conversation starters, and any flagged-but-not-critical content with context. Delivered at your preferred time each day.
5.3 Safety System Limitations
IMPORTANT: Our safety systems are not perfect and cannot guarantee your child's safety.
You acknowledge and agree that:
Technology limitations:
- Automated safety filters may fail to catch all inappropriate content
- AI may occasionally generate content that is unintended or inappropriate
- Safety alerts may not capture all concerning conversations
- False positives may occur (benign content triggering alerts)
- False negatives may occur (concerning content not triggering alerts)
Email delivery limitations:
- Email notifications depend on the reliable delivery and timely reading of email
- Emails may be delayed, filtered to spam, or not read promptly
- We cannot guarantee that you will see a critical alert email immediately
- You are responsible for ensuring that emails from Wander Lab are not filtered by your email provider
Not a substitute for parental supervision:
- Our platform cannot replace active parental involvement
- You must review daily digests and safety alert emails
- You are responsible for monitoring your child's overall online activity
- Technology cannot replicate parental judgment and oversight
No guarantee of child safety:
- We cannot prevent all exposure to inappropriate content
- We cannot prevent children from attempting to circumvent safety measures
- We cannot control how children interpret or apply information they receive
- We cannot predict or prevent all potential harms
5.4 Parental Responsibility
Parents and guardians remain ultimately responsible for their child's safety and wellbeing while using Wander Lab.
You agree to:
- Regularly review daily curiosity digest emails
- Check your email promptly and ensure emails from Wander Lab are not filtered to spam
- Respond promptly to critical safety alert emails
- Have open conversations with your child about their learning activities
- Set household rules for appropriate platform use
- Monitor your child's emotional and educational development
- Seek professional help if concerns arise about your child's wellbeing
5.5 Reporting Concerns
If you observe content or interactions that concern you, immediately:
- Contact us at info@everbot.tech
- Review your child's conversation history in your Parent Bridge dashboard
- Discuss the content with your child
- Consider consulting with appropriate professionals (teachers, counselors, etc.)
5.6 Emergency Situations
If your child is in immediate danger or experiencing a mental health crisis, DO NOT rely on Wander Lab notifications. Contact emergency services (911), the 988 Suicide & Crisis Lifeline, or appropriate professionals immediately.
6. Subscription and Payment Terms
6.1 Subscription Plans
Wander Lab is offered as a subscription service. Current pricing and plan details are available on our website. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
6.2 Payment Authorization
By providing payment information, you authorize us to charge your payment method for:
- Initial subscription fees
- Recurring subscription fees at the interval you selected (monthly/annually)
- Any applicable taxes
6.3 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.
6.4 Payment Processing
Payments are processed by Stripe, our third-party payment processor. We do not store your complete credit card information. By providing payment information, you agree to Stripe's terms and privacy policy.
6.5 Failed Payments
If a payment fails:
- We will attempt to charge your payment method up to 3 times
- You will receive email notifications about failed payments
- Your account may be suspended if payment cannot be processed
- Access will be restored upon successful payment
6.6 Refund Policy
Subscriptions are non-refundable except:
- As required by law
- At our sole discretion in cases of technical failures preventing service use
- Within the first 7 days of your initial subscription if you are not satisfied (one-time first subscription only)
To request a refund, contact info@everbot.tech with your account details and reason for the request.
6.7 Taxes
You are responsible for any sales, use, value-added, or other taxes associated with your subscription, except for taxes based on our net income.
7. Intellectual Property Rights
7.1 Our Intellectual Property
Wander Lab, including its software, design, content, features, functionality, and all materials, are owned by EverBot LLC and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial educational purposes only.
7.2 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of our platform
- Reverse engineer or attempt to extract source code
- Remove or alter any copyright, trademark, or proprietary notices
- Use our trademarks, logos, or branding without written permission
7.3 User-Generated Content
While conversations between your child and Arf are private to your account:
- You retain ownership of questions and inputs your child provides
- AI-generated responses are created using our service and are not owned by you
- We may use aggregated, anonymized data to improve our services
7.4 Feedback
If you provide feedback, suggestions, or ideas about Wander Lab, we may use them without any obligation to compensate you.
8. Privacy and Data Protection
8.1 Privacy Policy
Our collection, use, and protection of your and your child's personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8.2 Your Responsibilities
You agree to:
- Review our Privacy Policy
- Understand what data we collect and how we use it
- Provide only accurate information
- Protect your account credentials
- Exercise your parental rights to access, review, and delete your child's data
9. Disclaimers and Limitations of Liability
9.1 Service Provided "AS IS"
WANDER LAB IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
- Merchantability, fitness for a particular purpose, and non-infringement
- Accuracy, reliability, or completeness of content
- Uninterrupted, secure, or error-free service
- Results from using the platform
- Defects will be corrected
9.2 Educational Outcomes
WE DO NOT GUARANTEE:
- Specific educational outcomes or improvements
- Your child will learn particular skills or knowledge
- Academic performance will improve
- The platform will meet your child's specific educational needs
9.3 Technical Issues
We do not warrant that:
- The platform will be available at all times
- Service will be uninterrupted or error-free
- Defects will be corrected promptly
- The platform is free from viruses or harmful components
9.4 Third-Party Services
We are not responsible for:
- The availability, accuracy, or content of third-party services (Anthropic, Stripe, etc.)
- Any damages resulting from third-party service failures
- Third-party terms, policies, or practices
9.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERBOT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of profits, revenue, or data
- Loss of educational opportunities
- Emotional distress or psychological harm
- Costs of substitute services
- Any damages arising from your or your child's use of the platform
Any direct damages exceeding the amount you paid us in the 12 months preceding the claim.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.
9.6 Exclusions
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9.7 Basis of Bargain
You acknowledge that we have set our prices and entered into these Terms in reliance upon the limitations of liability and disclaimers set forth herein, and that the same form an essential basis of the bargain between us.
10. Indemnification
10.1 Your Agreement to Indemnify
You agree to indemnify, defend, and hold harmless EverBot LLC, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your or your child's use of the platform:
- Any violation of these Terms
- Any violation of applicable laws or regulations
- Any content your child submits or generates
- Your child's interactions with the AI
Your responsibilities as a parent/guardian:
- Failure to properly supervise your child's use
- Failure to respond to safety alert emails
- Decisions made based on AI-generated content
- Harm to your child resulting from platform use
Intellectual property claims:
- Claims that your child's use infringes third-party rights
- Unauthorized use of our intellectual property
Third-party claims:
- Claims by others arising from your account activity
- Claims related to your payment information
10.2 Defense and Settlement
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent.
10.3 Survival
This indemnification obligation survives termination of these Terms and your use of Wander Lab.
11. Termination
11.1 Termination by You
You may terminate your account at any time by:
- Using the account cancellation feature in your Parent Bridge dashboard
- Contacting us at info@everbot.tech
Upon cancellation:
- You will retain access through the end of your current billing period
- No refunds will be provided for the remaining subscription period (except as stated in Section 6.6)
- Automatic renewal will be disabled
- Your data will be handled according to our Privacy Policy
11.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, with or without notice, if:
Violation of Terms:
- You or your child violate these Terms or our Acceptable Use Policy
- You engage in fraudulent or illegal activity
- You provide false or misleading information
Payment Issues:
- Your payment method fails and you do not provide updated payment information
- You dispute valid charges (chargeback abuse)
Platform Protection:
- Your account poses security or technical risks to our platform
- Your use adversely affects other users or our service
Legal Requirements:
- We are required to terminate by law or government order
- Continuing to provide service would violate applicable laws
11.3 Effect of Termination
Upon termination for any reason:
- Your right to access and use Wander Lab immediately ceases
- We may delete your account data per our retention policy (see Privacy Policy)
- Sections of these Terms that by their nature should survive (including indemnification, disclaimers, and limitations of liability) will remain in effect
11.4 No Liability for Termination
We are not liable to you or any third party for any termination of your account or access to Wander Lab.
12. Dispute Resolution
12.1 Informal Resolution
Before filing any formal claim, you agree to contact us at info@everbot.tech to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.
12.2 Governing Law
These Terms are governed by the laws of Colorado, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts located in Jefferson County, Colorado for any disputes.
12.3 Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Wander Lab shall be resolved through binding arbitration, except:
- Small claims court cases (under jurisdictional limits)
- Claims for injunctive or equitable relief
- Intellectual property disputes
Arbitration terms:
- Administered by the American Arbitration Association (AAA)
- Conducted under AAA's Consumer Arbitration Rules
- Location: Evergreen, Colorado
- Each party pays their own costs unless otherwise required by law
- Arbitrator's decision is final and binding
- Judgment may be entered in any court of competent jurisdiction
12.4 Class Action Waiver
YOU AND EVERBOT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS MEMBER OR REPRESENTATIVE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
There will be no right or authority for any claims to be arbitrated or litigated on a class, collective, or representative basis.
12.5 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to info@everbot.tech within 30 days of accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
12.6 Severability
If any portion of this dispute resolution section is found to be unenforceable, the remainder shall remain in full force and effect.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and EverBot LLC regarding Wander Lab and supersede all prior agreements and understandings.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
13.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
13.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as expressly stated herein.
13.6 Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, or internet/telecommunication failures.
13.7 Notices
We may provide notices to you via:
- Email to your registered email address
- In-app notifications
- Updates posted on our website
You may provide notices to us at info@everbot.tech or via mail to our registered address.
13.8 Relationship
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and EverBot LLC.
13.9 Headings
Section headings are for convenience only and do not affect interpretation of these Terms.
13.10 Survival
Sections that by their nature should survive termination (including but not limited to Sections 7, 9, 10, and 12) will remain in effect after termination of these Terms.

BY CREATING AN ACCOUNT OR USING WANDER LAB, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms of Service
- You are at least 18 years old and are the parent/legal guardian of any children on your account
- You agree to be bound by these Terms and our Privacy Policy
- You understand the limitations and disclaimers regarding AI accuracy and safety systems
- You accept responsibility for supervising your child's use of the platform
- You agree to the arbitration and class action waiver provisions
- You understand that we cannot guarantee specific educational outcomes or your child's safety
If you do not agree to these Terms, you must not access or use Wander Lab.
